It is also reported that these Conditions may be modified. The User is responsible for consulting them each time they access, browse and/or use the Website, as those in force at the time of requesting the purchase of products and/or services will apply.

2. THE USER

Accessing, browsing and using the Website confers the status of user (hereinafter referred to, interchangeably, individually as User or collectively as Users), therefore, from the moment browsing begins on the Website, all the Conditions set forth here, as well as their subsequent modifications, are accepted, without prejudice to the application of the corresponding legal regulations that are mandatory as the case may be.

The User assumes responsibility for the correct use of the Website. This responsibility will extend to:

  • Using this Website solely to make inquiries and purchases or legally valid acquisitions.

  • Not making any false or fraudulent purchases. If it could reasonably be considered that a purchase of this nature has been made, it could be cancelled and the relevant authorities would be informed.

  • Providing truthful and lawful contact details, for example, email address, postal address and/or other data (see Legal Notice and General Conditions of Use).

The User declares that they are over 18 years of age and have the legal capacity to enter into contracts through this Website.

The Website is primarily aimed at Users residing in Spain. Iberian Supplies does not guarantee that the Website complies with the legislation of other countries, either in whole or in part. Iberian Supplies disclaims all responsibility that may arise from such access, nor does it guarantee shipments or the provision of services outside of Spain.

The User may formalise, at their choice, with Iberian Supplies the contract for the sale of the desired products and/or services in any of the languages in which these Terms are available on this Website.

3. PURCHASE OR ACQUISITION PROCESS

Registered Users can purchase on the Website by the means and methods established. They must follow the online purchase and/or acquisition procedure at https://iberiansupplies.com, during which various products and/or services can be selected and added to the cart, basket, or final purchase space, and finally, click on: "Buy and pay".

Additionally, the User must fill in and/or verify the information requested at each step, although, during the purchase process, before making the payment, the purchase details can be modified.

Subsequently, the User will receive an email confirming that Iberian Supplies has received their order or request for purchase and/or service provision, that is, the order confirmation. And, if applicable, they will also be informed via email when their purchase is being shipped. If applicable, this information may also be made available to the User through their personal connection space on the Website.

Once the purchase procedure has concluded, the User consents to the Website generating an electronic invoice that will be sent to the User via email and, where applicable, through their personal connection space on the Website. Furthermore, the User may, if they wish, obtain a paper copy of their invoice by requesting it from Iberian Supplies using the contact spaces on the Website or through the contact details provided above.

The User acknowledges being aware, at the time of purchase, of certain specific sales conditions that pertain to the product and/or service in question and that are displayed alongside the presentation or, where applicable, image of it on its page on the Website, indicating, by way of example but not limited to, and depending on each case: name, price, components, weight, quantity, colour, product details, or characteristics, the manner in which they will be carried out and/or the cost of the services; and acknowledges that placing the order for purchase or acquisition constitutes full and complete acceptance of the specific sales conditions applicable to each case.

The communications, purchase orders, and payments involved during the transactions carried out on the Website may be archived and stored in the computerised records of Iberian Supplies in order to constitute a means of proof of transactions, in any case, respecting reasonable security conditions and the applicable laws and regulations in this regard, and particularly taking into account Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights, and the rights that Users have in accordance with the privacy policy of this Website.

Unless expressly stated otherwise, Iberian Supplies is not the manufacturer of the products sold or that may be marketed on the Website. Although Iberian Supplies makes great efforts to ensure that the information displayed on the Website is correct, sometimes the packaging and/or materials and/or components of the products may contain additional or different information from that appearing on the Website. Therefore, the User should not only consider the information provided by the Website but also the information available on the labeling, warnings and/or instructions accompanying the product.

4. AVAILABILITY

All purchase orders received by Iberian Supplies through the Website are subject to the availability of the products and/or to no circumstance or force majeure cause (clause nine of these Conditions) affecting the supply of the same and/or the provision of services. If difficulties arise regarding the supply of products or if there are no products in stock, Iberian Supplies commits to contacting the User and refunding any amount that may have been paid as a deposit. This will also apply in cases where the provision of a service becomes unfeasible.

5. PRICES AND PAYMENT

The prices displayed on the Website are final, in Euros (€) and include taxes, unless a different issue is indicated and applied due to legal requirements, especially regarding VAT.

Shipping costs are not included in the final prices of the products as shown on the Website. Thus, Iberian Supplies provides delivery and/or shipping services through: TIPSA.

The prices of the offered items exclude any shipping costs that may be incurred, which will be added to the total amount due at the time the User manages the shipping procedure, where they will consult the available shipping methods and costs and freely choose the one that suits them best.

Under no circumstances will the Website automatically add additional costs to the price of a product or service, but only those that the User has voluntarily and freely selected and chosen.

Prices may change at any time, but any potential changes will not affect orders or purchases for which the User has already completed the purchase request process on the Website as indicated in paragraph one of clause three upon receiving an order confirmation.

Accepted payment methods will be: Credit or debit card, PayPal, Bank transfer or direct debit.

Iberian Supplies uses all means to ensure the confidentiality and security of the payment data transmitted by the User during transactions through the Website. As such, the Website uses a secure payment system SSL (Secure Socket Layer).

Credit cards will be subject to checks and authorisations by the issuing bank, if that bank does not authorise the payment, Iberian Supplies will not be responsible for any delay or failure to deliver and will not be able to formalise any contract with the User.

Once Iberian Supplies receives the purchase order from the User through the Website, a pre-authorisation will be made on the corresponding card to ensure that there are sufficient funds to complete the transaction. The charge on the card will be made at the moment the User is sent the shipping confirmation and/or confirmation of the service provided in the established form and, where applicable, place.

If the payment method is PayPal, gift card or prepaid card, the charge will be made at the moment when Iberian Supplies sends a confirmation of the purchase order or acquisition of products and/or services to the User.

In any case, by clicking on "Buy and pay" the User confirms that the payment method used is theirs, or that, in their case, they are the legitimate holder of the gift card or the prepaid card.

Purchase or acquisition orders in which the User selects bank transfer as the payment method will be reserved for 5 calendar days from the confirmation of the order to allow sufficient time for the bank transfer to be taken into account by the payment system used by Iberian Supplies for the Website. When the system receives the transfer, the order will be prepared and managed for shipping.

By this payment method, the User must ensure that they correctly enter the exact amount of the purchase order, as well as the account number and the reference of the transfer. In case of error, Iberian Supplies will not be able to validate the order, which will be cancelled.

For cash on delivery, the User must select "Cash on Delivery" among the payment methods on the Website and continue to Buy and pay to place the purchase order. From that moment, Iberian Supplies reserves the right to contact the User in order to validate the purchase order with them. After this, the order will be prepared and made available for shipping management.

Payment will be made at the time of delivery of the order by the carrier's delivery person. Payment will be made only in cash. The User agrees to provide the delivery person with the exact amount of the order, as they will not be able to provide change.

For the refund of the amount on orders paid by cash on delivery, Iberian Supplies reserves the right to 14 calendar days after the return has been requested through the Website and the package has been returned to the carrier. When making the return, the User must provide their bank details to receive the transfer corresponding to the requested refund of the amount for the returned order. The refund of the amount for orders paid by cash on delivery will be made solely by bank transfer.

Iberian Supplies reserves the right to suspend cash on delivery payments to those Users who have not met the necessary requirements in past orders.

6. DELIVERY

In cases where physical delivery of the contracted good is required, deliveries will be made within the following territory: Spain (Mainland and Balearic Islands).

Except in cases where there are unforeseen or extraordinary circumstances or, where applicable, arising from the customisation of the products, the purchase order consisting of the products listed in each purchase confirmation will be delivered within the timeframe indicated on the Website according to the shipping method selected by the User and, in any case, within a maximum period of 30 calendar days from the date of order confirmation.

If for any reason attributable to them, Iberian Supplies is unable to meet the delivery date, they will contact the User to inform them of this circumstance, and the User may choose to proceed with the purchase by establishing a new delivery date or cancel the order with a full refund of the price paid. In any case, home deliveries are made on working days.

If it becomes impossible to deliver the order due to the User's absence, the order may be returned to the warehouse. However, the carrier would leave a notice explaining where the order is and how to arrange for it to be delivered again.

If the User will not be at the delivery location during the agreed time slot, they must contact Iberian Supplies to arrange for delivery on another day.

In the event that 30 days pass since the order is available for delivery, and it has not been delivered for reasons not attributable to Iberian Supplies, Iberian Supplies it will be understood that the User wishes to withdraw from the contract and it will be considered resolved. As a consequence of the resolution of the contract, all payments received from the User will be refunded, except for any additional costs resulting from the User's choice of a delivery method other than the least expensive standard delivery option offered by the Website, without any undue delay and, in any case, within a maximum period of 14 calendar days from the date the contract is considered resolved.

However, the User should be aware that the transport resulting from the resolution may incur an additional cost that may be charged to them.

For the purposes of these Terms, it will be understood that delivery has taken place or that the order has been delivered at the moment when the User or a third party indicated by the User takes physical possession of the products, which will be evidenced by the signature of the receipt of the order at the agreed delivery address.

The risks that may arise from the products will be the responsibility of the User from the moment of delivery. The User acquires ownership of the products when Iberian Supplies receives full payment of all amounts due in relation to the purchase or acquisition made, including shipping costs, or at the time of delivery, if this occurs at a later time than the complete receipt of the payment amount by Iberian Supplies.

In accordance with the provisions of Law 37/1992, of 28 December, on Value Added Tax (VAT), purchase orders for delivery and/or provision will be understood to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory except for the Canary Islands, Ceuta, and Melilla. The applicable VAT rate will be the legally in force at any given time depending on the specific article in question.

In this same sense, and in accordance with Chapter I of Title V of Directive 2006/112 of the Council of 28 November 2006 on the common VAT system, purchase orders will be located, for their delivery and/or provision, in the Member State of the European Union where the address stated in the purchase order is located and, therefore, the applicable VAT will be that in force in that Member State.

For orders destined for the Canary Islands, Ceuta, and Melilla, deliveries will be exempt from VAT in accordance with the provisions of Law 37/1992 and Directive 2006/112, without prejudice to the application of the corresponding taxes and duties in accordance with the current regulations in each of these territories. The User should be aware that in these territories there may be situations where taxes and customs duties apply and accrue at destination, in accordance with the current regulations, and that these may be at their expense.

For all other locations, different from the above, where purchase orders are located, the current regulations will apply at all times for their delivery and/or provision; the User should be aware that this may generate the application and accrual of taxes and customs duties at destination, in accordance with the current regulations at destination, and that these may be at their expense. For further information, the User should contact the customs office at destination.

7. TECHNICAL MEANS TO CORRECT ERRORS

The User is informed that if they detect an error in entering the necessary data to process their purchase request on the Website, they may modify it by contacting Iberian Supplies through the contact spaces provided on the Website, and, where applicable, through those provided to contact customer service, and/or using the contact details provided in the first clause (General information). Furthermore, this information may also be corrected by the User through their personal connection space on the Website.

In any case, the User, before clicking on "Buy and pay", has access to the area, cart, or basket where their purchase requests are recorded and can make modifications.

Similarly, the User is referred to consult the Legal Notice and General Terms of Use and, in particular, the Privacy Policy for more information on how to exercise their right of rectification as established in Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data (GDPR) and in Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights.

8. RETURNS

In cases where the User purchases products on or through the Owner's Website, they are entitled to a series of rights, as listed and described below:

Right of Withdrawal

The User, as a consumer and user, makes a purchase on the Website and, therefore, has the right to withdraw from that purchase within 14 calendar days without the need for justification.

This withdrawal period will expire 14 calendar days from the day the User or a third party authorised by them, other than the carrier, took possession of the physical goods purchased on the Website of Iberian Supplies or in the case that the goods comprising your order are delivered separately, within 14 calendar days from the day that the User or a third party authorised by them, other than the carrier, took possession of the last of those goods that made up the same purchase order, or in the case of a service contract, within 14 calendar days from the day of the conclusion of the contract.

To exercise this right of withdrawal, the User must notify their decision to Iberian Supplies. They may do so, where applicable, through the contact spaces provided on the Website.

The User, regardless of the means they choose to communicate their decision, must express clearly and unequivocally that it is their intention to withdraw from the purchase contract. In any case, the User may use the model withdrawal form that Iberian Supplies makes available to them as an annex to these Conditions, however, its use is not mandatory.

To meet the withdrawal period, it is sufficient that the communication expressing unequivocally the decision to withdraw is sent before the corresponding period expires.

In the event of withdrawal, Iberian Supplies will reimburse the User the payment received, including shipping costs (with the exception of additional costs chosen by the User for a shipping method other than the least expensive method offered on the Website) without any undue delay and, in any case, no later than 14 calendar days from the date on which Iberian Supplies is informed of the User's decision to withdraw.

Iberian Supplies will refund the User using the same payment method that they used to make the initial purchase transaction. This refund will not incur any additional cost to the User. However, Iberian Supplies may withhold this refund until it has received the products or items from the purchase, or until the User provides proof of their return, whichever condition is met first.

and must do so without any undue delay and, in any case, no later than 14 calendar days from the date on which Iberian Supplies was informed of the decision to withdraw.

The User acknowledges that they must bear the direct cost of returning the goods (transport, delivery), if any are incurred. Furthermore, they will be responsible for any decrease in value of the products resulting from handling that is not necessary to establish the nature, characteristics, and functioning of the goods.

The User acknowledges that there are exceptions to the right of withdrawal, as set out in Article 103 of Royal Legislative Decree 1/2007, of 16 November, which approves the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws. By way of example, and not limitation, this would be the case for: personalised products; products that may deteriorate or expire quickly; CDs/DVDs of music or video without their packaging, as sealed at the factory; products that for hygiene or health reasons are sealed and have been unsealed after delivery; supply of digital content without physical support.

In the same vein, the provision of a service that the User may contract on this Website is governed, as this same Law establishes that the right of withdrawal will not apply to Users when the service has been fully performed, or when it has begun, with the express consent of the consumer and user and with their acknowledgment that they are aware that, once the contract has been fully executed by Iberian Supplies, they will have lost their right of withdrawal.

In any case, no refund will be made if the product has been used beyond mere opening, for products that are not in the same condition as they were delivered or that have suffered any damage after delivery.

Likewise, products must be returned using or including all their original packaging, instructions, and any other documents that may accompany them, as well as a copy of the purchase invoice.

Return of defective products or shipping errors

This refers to all cases in which the User believes that, at the time of delivery, the product does not conform to what is stipulated in the contract or purchase order, and therefore, must contact Iberian Supplies immediately and inform them of the existing disagreement (defect/error) by the same means or using the contact details provided in the previous section (Right of Withdrawal).

The User will then be informed about how to proceed with the return of the products, and these, once returned, will be examined and the User will be informed, within a reasonable time frame, whether a refund is appropriate or, if applicable, a replacement.

The refund or replacement of the product will be carried out as soon as possible and, in any case, within 14 days following the date on which we send you an email confirming that a refund or replacement of the non-conforming item is appropriate.

The amount paid for those products that are returned due to a defect, when one truly exists, will be fully refunded, including delivery charges and any costs that the User may have incurred to make the return. The refund will be made using the same payment method that the User used to pay for the purchase.

In any case, the rights recognised in the current legislation at any given time for the User, as a consumer and user, will always be upheld.

Warranties

The User, as a consumer and user, enjoys warranties on the products that may be purchased through this Website, under the legally established terms for each type of product, responding Iberian Supplies, therefore, due to the lack of conformity of the same that is manifested within a period of three years from the delivery of the product.

In this regard, it is understood that the products are in conformity with the contract as long as: they match the description made by Iberian Supplies, and possess the qualities presented therein; are suitable for the uses to which products of the same type are ordinarily intended; and present the usual quality and performance of a product of the same type that are fundamentally to be expected from it. When this is not the case regarding the products delivered to the User, they must proceed as indicated in the section on Returns of defective products or errors in shipping. However, some of the products marketed on the Website may present non-homogeneous characteristics as long as these derive from the type of material with which they have been manufactured, and therefore will form part of the individual appearance of the product, and will not be a defect.

On the other hand, it may occur that the User purchases a product on the Website from a brand or manufactured by a third party. In this case, and considering the User believes it to be a defective product, they also have the option to contact the brand or manufacturer responsible for the product to find out how to exercise their legal warranty rights directly against them during the three years following the delivery of such products. 9. DISCLAIMER

Unless otherwise provided by law, Iberian Supplies will not accept any responsibility for the following losses, regardless of their origin:

  • any losses that are not attributable to any breach on its part;

  • business losses (including loss of profit, income, contracts, anticipated savings, data, loss of goodwill or unnecessary expenses incurred); or

  • any other indirect loss that was not reasonably foreseeable by both parties at the time the sales contract for the products was formalised between both parties.

Likewise, Iberian Supplies also limits its liability in the following cases:

  • Iberian Supplies takes all measures concerning the provision of an accurate representation of the product on the website; however, it is not responsible for any minor differences or inaccuracies that may exist due to lack of screen resolution, or issues with the browser used or other similar matters.
  • Iberian Supplies will act with the utmost diligence to make the product available to the company responsible for transporting the product subject to the purchase order. However, it is not responsible for damages arising from a malfunction of the transport, especially due to causes such as strikes, roadblocks, and generally any other issues typical of the sector, which result in delays, losses or theft of the product.
  • Technical failures due to fortuitous causes or other reasons that prevent the normal functioning of the service via the internet. Lack of availability of the Website for maintenance or other reasons that prevent access to the service. Iberian Supplies makes every effort to carry out the process of purchasing, payment, and shipping/delivery of the products; however, it is exempt from liability for causes that are not attributable to it, fortuitous events or force majeure.
  • Iberian Supplies will not be responsible for the misuse and/or wear of the products that have been used by the User. At the same time, Iberian Supplies will also not be responsible for an incorrect return made by the User. It is the User's responsibility to return the correct product.

  • In general, Iberian Supplies will not be liable for any breach or delay in fulfilling any of the obligations assumed when this is due to events that are outside its reasonable control, that is to say, due to force majeure, which may include, by way of example but not limited to:

    • Strikes, employer lockouts or other protest measures.
    • Civil commotion, riot, invasion, threat or terrorist attack, war (declared or not) or threat or preparations for war.
    • Fire, explosion, storm, flood, earthquake, sinking, epidemic or any other natural disaster.
    • Inability to use trains, ships, planes, motor transport or other means of transport, public or private.
    • Inability to use public or private telecommunications systems.
    • Acts, decrees, legislation, regulations or restrictions of any government or public authority.

In this way, the obligations will be suspended for the period during which the force majeure cause continues, and Iberian Supplies will have an extension of the deadline to fulfil them for a period equal to the duration of the force majeure cause. Iberian Supplies will make all reasonable efforts to find a solution that allows it to meet its obligations despite the force majeure.

10. WRITTEN COMMUNICATIONS AND NOTIFICATIONS

By using this Website, the User agrees that most communications with Iberian Supplies will be electronic (email or notices published on the Website).

For contractual purposes, the User consents to use this electronic means of communication and acknowledges that any contract, notification, information and other communications that Iberian Supplies sends electronically meet the legal requirements of being in writing. This condition will not affect the rights recognised by law to the User.

The User may send notifications and/or communicate with Iberian Supplies through the contact details provided in these Conditions and, where applicable, through the contact spaces on the Website.

Likewise, unless otherwise stipulated, Iberian Supplies may contact and/or notify the User at their email or at the postal address provided.

11. WAIVER

No waiver by Iberian Supplies of a specific right or legal action or the failure to require strict compliance by Iberian Supplies of the User's obligations shall constitute a waiver of other rights or actions arising from a contract or the Conditions, nor shall it exempt the User from fulfilling their obligations.

No waiver by Iberian Supplies of any of these Conditions or of the rights or actions arising from a contract shall take effect unless it is expressly stated to be a waiver and is formalised and communicated to the User in writing.

12. NULLITY

If any of these Conditions are declared null and void by a final ruling issued by a competent authority, the remaining clauses shall remain in force, unaffected by such declaration of nullity.

13. COMPLETE AGREEMENT

These Conditions and any document expressly referred to herein constitute the entire agreement between the User and Iberian Supplies in relation to the subject of the sale and replace any other prior verbal or written agreement, covenant, or promise made by the same parties.

The User and Iberian Supplies acknowledge that they have consented to enter into a contract without relying on any statement or promise made by the other party, except for what is expressly mentioned in these Conditions.

14. DATA PROTECTION

The information or personal data that the User provides to Iberian Supplies during a transaction on the Website will be processed in accordance with the provisions of the Privacy Policy or data protection policy (contained, where applicable, in the Legal Notice and General Terms of Use). By accessing, browsing and/or using the Website, the User consents to the processing of such information and data and declares that all information or data provided is true.

15. APPLICABLE LEGISLATION AND JURISDICTION

Likewise, if a dispute arises from the celebration of this purchase contract between Iberian Supplies and the User, the User as a consumer may request an out-of-court dispute resolution, in accordance with Regulation (EU) 524/2013 of the European Parliament and of the Council, of 21 May 2013, on online dispute resolution for consumer matters and amending Regulation (EC) 2006/2004 and Directive 2009/22/EC.
